ALABAMA COURT OF CIVIL APPEALS OCTOBER TERM, 2016-2017 _________________________ 2150631 _________________________ Brianna Horton v. Bria Monique Hinton Appeal from Tuscaloosa Circuit Court (CV-15-900165) PITTMAN, Judge. Brianna Horton appeals from a judgment of the Tuscaloosa Circuit Court dismissing her personal-injury action as a sanction for disregarding the requirements of the discovery process. We affirm the trial court's judgment. 2150631 In February 2015, Horton sued Bria Monique Hinton, alleging that Hinton had negligently or wantonly operated an automobile in a manner so as to strike Horton. Horton also asserted that Hinton's actions amounted to outrageous conduct and that Horton had suffered emotional distress as a result of that alleged conduct. In June 2015, Hinton filed a motion to dismiss Horton's action, alleging that Horton had failed to respond to interrogatories and requests for production of documents, that the trial court had entered an order compelling Horton to respond to those discovery requests, and that Horton had failed to comply with the trial court's order. Apparently, after Hinton had filed her motion to dismiss, Horton responded to the discovery requests, and the trial court entered an order denying Hinton's motion to dismiss as moot. The record indicates that, subsequently, Hinton scheduled Horton's deposition for a date in October 2015, that Hinton later canceled that deposition at Horton's request, that Hinton sent two letters to Horton's counsel requesting potential dates for the rescheduling of Horton's deposition, and that Horton failed to 2 respond to those letters. 2150631 Accordingly, Hinton chose a new date for Horton's deposition and issued a new notice of deposition. On the date set for Horton's deposition, Hinton's counsel traveled from Birmingham to Tuscaloosa to depose Horton, but neither Horton nor her counsel appeared for the deposition. There is no explanation in the record as to why Horton and her counsel failed to appear. In response to a motion to compel, the trial court entered an order directing Horton to make herself available for deposition within 21 days "or be subject to possible dismissal" of her action. Hinton rescheduled and re-noticed Horton's deposition, and, although Horton's counsel appeared at the scheduled time and location, Horton did not. Accordingly, Hinton filed a motion to dismiss Horton's action. One month after Hinton had filed her motion to dismiss, to which Horton had not responded, the trial court entered a judgment dismissing the action. Thereafter, Horton filed a postjudgment motion requesting the trial court to "reconsider" that ruling. Also, what begins as Lau accepting employment with Fogg as a means of flying under radar eventually becomes a genuine friendship. The same is true with Monique. When separating for good seems the most logical course of action, Lau and Monique let their concern for Fogg motivate a Pacific crossing to rejoin Fogg in San Francisco. When Lau views a fire in an apartment he risks his own life to extinguish it.Spiritual ElementsBuddhism is the only religion given screen time, and the treatment of it comes across as something of an endorsement. Not only does Lau describe the jade Buddha as a “very sacred object” that “protects [his] village,” but when the idol is returned to its shrine, the townsfolk gather around it, bowing low in reverence. What makes this scene additionally troublesome is that Monique (a French woman) worships in the same manner—although nothing previous in the film would suggest she is a Buddhist. (AP) — Computer scientists who helped build the foundations of today’s artificial intelligence technology are warning of its dangers, but that doesn’t mean they agree on what those dangers are or how to prevent them. Humanity’s survival is threatened when “smart things can outsmart us,” so-called Godfather of AI Geoffrey Hinton said at a conference Wednesday at the Massachusetts Institute of Technology.“It may keep us around for a while to keep the power stations running,” Hinton said. “But after that, maybe not.”After retiring from Google so he could speak more freely, the 75-year-old Hinton said he’s recently changed his views about the reasoning capabilities of the computer systems he’s spent a lifetime researching.“These things will have learned from us, by reading all the novels that ever were and everything Machiavelli ever wrote, how to manipulate people,” Hinton said, addressing the crowd attending MIT Technology Review’s EmTech Digital conference from his home via video. “Even if they can’t directly pull levers, they can certainly get us to pull levers.” “I wish I had a nice simple solution I could push, but I don’t,” he added. “I’m not sure there is a solution.”Fellow AI pioneer Yoshua Bengio, co-winner with Hinton of the top computer science prize, told The Associated Press on Wednesday that he’s “pretty much aligned” with Hinton’s concerns brought on by chatbots such as ChatGPT and related technology, but worries that to simply say “We’re doomed” is not going to help. “The main difference, I would say, is he’s kind of a pessimistic person, and I’m more on the optimistic side,” said Bengio, a professor at the University of Montreal. “I do think that the dangers — the short-term ones, the long-term ones — are very serious and need to be taken seriously by not just a few researchers but governments and the population.” There are plenty of signs that governments are listening. The White House has called in the CEOs of Google, Microsoft and ChatGPT-maker OpenAI to meet Thursday with Vice President Kamala Harris in what’s being described by officials as a frank discussion on how to mitigate both the near-term and long-term risks of their technology. European lawmakers are also accelerating negotiations to pass sweeping new AI rules.But all the talk of the most dire future dangers has some worried that hype around superhuman machines — which don’t exist — is distracting from attempts to set practical safeguards on current AI products that are largely unregulated and have been shown to cause real-world harms.Margaret Mitchell, a former leader on Google’s AI ethics team, said she’s upset that Hinton didn’t speak out during his decade in a position of power at Google, especially after the 2020 ouster
